Agreement to terms

These Terms & Conditions ("Terms") govern your access to and use of commissionx.agency (the "Site") and the appointment-booking services (the "Services") provided by:

By booking a strategy call, signing up for a plan, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or the Services.

Who this is for

The Services are offered to licensed real estate brokers and agents for use in their professional capacity. By using the Services, you represent that you hold an active real estate license in the market you're purchasing.

What we provide

We run paid advertising, automated SMS qualification, and live-call verification to generate and confirm seller appointments, which are delivered to you exclusively within your contracted territory, under the plan you selected (Appointments Plan or CommissionX Plan, as described on our Pricing page).

Fees & billing

Fees are billed according to the plan and tier you select at signup, as described on our Pricing page or agreed on your strategy call. The Appointments Plan is billed per appointment delivered; the CommissionX Plan is billed as a flat recurring fee plus a percentage of closed commission, as outlined at the time of signup.

Delivery timelines & no refunds

We work to deliver the appointment volume associated with your plan and tier consistently, but ad performance, seller responsiveness, and market conditions can affect how quickly appointments come in during any given period.

We do not offer refunds. If the number of appointments delivered in a given period falls short of what's expected for your tier, we do not issue a refund for that shortfall. Instead, we continue working your territory and may take additional time in a following period to deliver the appointment volume owed under your plan. Fees already paid are applied toward the appointments we deliver, on the extended timeline if needed, not returned.

Exclusivity & territory

Where a plan includes exclusive territory, we work with one broker or team per contracted market at a time. Territory boundaries and availability are confirmed on your strategy call and may be adjusted only by mutual written agreement.

Term & cancellation

Plans run month-to-month unless otherwise agreed in writing. You may cancel at any time, effective at the end of your current billing period; cancellation does not retroactively refund fees already paid for appointments delivered or owed under the section above.

No guarantee of sales

We book and confirm seller appointments. We do not control, and make no guarantee regarding, whether any appointment results in a listing agreement, a sale, or any particular commission outcome. Show rates and other figures referenced on this Site reflect our own performance data and are not a guarantee of results for your market.

Your responsibilities

You're responsible for showing up to confirmed appointments, complying with all licensing, advertising, and fair housing laws applicable to your own real estate practice, and for the conduct of your team in any appointment we deliver.

Disclaimers & limitation of liability

The Services are provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, CX Digital Media LLC's total liability arising from your use of the Services is limited to the fees you paid us in the three (3) months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost commissions.

Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Wyoming.

Changes to these terms

We may update these Terms from time to time. We'll post any changes on this page with a revised effective date. Continued use of the Services after a change takes effect constitutes acceptance of the updated Terms.
